1. Company information

TiendaPop is operated by SHOPTIC WORKS LLC, a company incorporated under the laws of the State of Delaware, United States, with its principal place of business at 848 Brickell Ave. Ste 1225, Miami, FL, 33131.

2. Acceptance of terms

By accessing or using TiendaPop, you accept these Terms & Conditions in their entirety, together with any complementary policies (e.g., the Privacy Policy).

If you do not agree, do not use the service. Your acceptance is confirmed when you register, purchase credits, or use the Platform in any way.

3. Description of service

TiendaPop is a SaaS platform to generate images, videos, and other content with artificial intelligence, as well as to edit, manage, and integrate them with digital platforms (e-commerce, social media, and third-party APIs).

Third-party integrations: TiendaPop may facilitate integrations with external services (AI APIs, e-commerce platforms, social networks). Those services have their own terms and policies, independent from TiendaPop. We do not guarantee their availability or operation, nor do we assume responsibility for their content. You are responsible for connecting your accounts at your own risk and for complying with the terms of the external platforms when you publish there content generated on TiendaPop.

4. Use of artificial intelligence

When you use TiendaPop, you acknowledge and accept that:

• The generated content may not be unique, original, or exclusive.
• It may contain errors, biases, or inaccuracies.
• It may be similar or identical to content generated by other users.
• We do not guarantee that it is suitable for legal, commercial, or regulatory purposes.

You assume all risk for the use you make of the generated content.

5. Registration and account

To use certain features you must register and create a personal account. You agree to provide truthful, up-to-date, and complete information, and to keep your credentials confidential. You are responsible for all activity carried out from your account.

The service is intended for people over 18 years of age or for minors duly authorized by their parents or legal guardians. By registering, you declare that you meet this age and legal capacity requirement. TiendaPop may reject registration or cancel accounts that do not meet the eligibility requirements.

6. Credits and payments

TiendaPop operates with a system of virtual credits that you purchase and use to access the content generation features.

Credit purchases: You acquire credits through Stripe as the sole enabled payment provider. Prices of packages and subscription plans may change at any time.

Credit-to-content ratio: The relationship between credits and generated content (how many images or seconds of video are obtained per credit) may vary over time. TiendaPop may adjust the amount of credits required per action or feature. The current information is published on the Platform and updated periodically.

Validity and refunds: Unless applicable law states otherwise, credits are not refundable in cash and do not constitute legal tender. Each package may have a validity or expiration date defined at the time of purchase. Credits not used within their period may lose validity.

TiendaPop may modify the value, use, or availability of credits and associated features, communicating material changes to users through the site, the app, or the registered email.

7. Acceptable use and prohibited content

You agree to use TiendaPop in a lawful and respectful manner. You may not use the Platform to:

• Generate or share illegal, offensive, violent, or discriminatory content.
• Infringe intellectual property rights, image rights, or privacy of third parties.
• Use the image of public or private individuals without authorization.
• Generate deceptive or manipulative content (including deepfakes).
• Generate political, adult, or illegal content.
• Introduce viruses, malware, or affect the operation of the Platform.
• Carry out fraudulent activities, harass other users, or use the service for unlawful purposes.

TiendaPop may remove content, suspend or cancel accounts, and take other measures in response to violations, without prior notice.

You agree to defend, indemnify, and hold harmless TiendaPop (including SHOPTIC WORKS LLC, its directors, employees, and affiliates) against any claim, damage, or cost arising from:

• Your use of the service.
• The content you upload or generate.
• The violation of third-party rights or applicable laws.

10. Disclaimer of warranties

The Platform is offered "as is" and "as available".

TiendaPop does not warrant:

• Continuous or uninterrupted operation.
• Specific results.
• Absence of errors.
• Legal compliance of the generated content.
• Accuracy or suitability of the generated content for your purposes.

11. Limitation of liability

To the maximum extent permitted by law:

• TiendaPop is not liable for indirect, incidental, consequential, or punitive damages.
• It is not liable for loss of revenue, data, business opportunities, or lost profits.
• It is not liable for the use you make of the generated content.

TiendaPop's total liability to you is limited to the amount you have paid in the 12 months prior to the event giving rise to the claim, or to the replenishment of equivalent credits at TiendaPop's option.

12. Modifications to the service and the terms

TiendaPop may modify or suspend the service, as well as update these Terms. Changes take effect from their publication on the Platform. Continued use of the service after the update implies acceptance of the new Terms.

13. Suspension and cancellation

TiendaPop may suspend or cancel your account at any time, especially if:

• You misuse the service.
• You violate these terms.
• There are legal or regulatory risks.
• You commit fraud or deceptive activities.

You may cancel your account whenever you want. Cancellation does not entitle you to a refund of unused credits, unless applicable law provides otherwise.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without prejudice to mandatory consumer protection provisions that may apply in your jurisdiction of residence.

15. Dispute resolution

Any dispute arising from these Terms or the use of the service is resolved through binding arbitration under the rules of the American Arbitration Association (AAA), except where applicable law mandates another form of mandatory resolution.
